In September, 1975, Ashland Chemical submitted phthalic anhydride specifications for our acceptance. A1 Uelner's and John Roarty's comments were discussed with Ashland Chemical. Harry Pugh informed us that Ashland was reluctant to make any exceptions; but suggested that we notify them before hand if there is a need to ship material which does not meet their specification.
We rejected Ashland's proposed specifications primarily because we do not test for % phthalic anhydride or phthalate ester color; therefore, we are in no position to comply with Ashland's suggestion.
I discussed with A1 and John the current procedure being followed which I understand is as follows:
A sample of the shipment is analyzed for Crystallization Point, Color of Melt and Heat Stability. If any of these does not meet Ashland specification, Ashland will be informed before shipment is made. Unless anyone can foresee any problems, I suggest we continue to follow this procedure.
Regarding Ashland's request for "Certificates of Analysis", we do provide "Certificates of Quality". I understand from Art Uelner that we show % phthalic anhydride and phthalate ester color on the certificates although we do not run these tests for each shipment. % phthalic anhydride may be shown but should be foot noted to show that it is determined on a statistically sound basis, but not for every shipment. Phthalate ester color should not be certified unless actually performed. I recommend each of you review your practices regarding the preparation of "Certificates of Quality"

The effects of exposure of PCBs on our employees have been reviewed by our Medical Department and a consultant from the Eppley Institute, University of Nebraska. In summary, there no evidence that our employees have been adversely effected by PCBs. A copy of the Eppley Institute report is attached.

As requested, I have reviewed the status of PCB toxicity studies with George Levinskas. Referring to the action plan issued September 18th (copy attached), all items have been completed except for Nos. 5 and 7.
. Manufacturing management has a copy of Dr, Roush's employee exposure guidelines. Plant management plans to review them with the Medical Department before implementing.

George Levinskas informs me that drafts of the Industrial Bio-Test reports are virtually completed. Publication is possible by April if we buy an issue of the publication. If we cannot purchase, publication will be delayed to June-July..
Because of the impact that Dr. James Allen's primate study has had our Medical Department believes it is highly desirable that Monsanto sponsor some work with monkeys. A protocol will be prepared and sent to laboratories to determine the cost of such a study. Results of the study would not be available for at least one year..
No further toxicity studies with PCBs are planned at present.

In response to Westinghouse's request for definitions of Flammability, Toxicity and Environmental Pollutant, I have the following comments to offer.
George Levinskas of our Medical Department is preparing for you a definition for Toxicity. As soon as I receive it I will forward it to you.
The definition for Flaitmability can best be answered by sharing the attached copies of the OSHA definitions which appeared in the Federal Registery a summary prepared by Ralph Munch and the Underwriter's Laboratories Tests 340 which have been used for electrical fluids.
Environmental Pollutant could be defined as a material introduced by the actions of man and introduced into the environment where it could breate or have the potential to create significant adverse affects on human health or on other beneficial living species.

It appears that Woodson-Tenant was supplying information that was erroneous and falsified. Since Monsanto recommend this laboratory and had Bob Kaley visit their facilities to determine their capability, I personally find Woodson-Tenant's performance very disturbing.
I recommend that we be very careful in recommending this laboratory to our customers in the future.

formerly manufactured were solids* These were Aroclor 5460 and
Montar 5. Aroclor 5460 was shipped in 100# multiwall paper bags.
Montar 5 was shipped in 40 gallon fiber drums.

Warren Easley telephoned the following preliminary information regarding EPA Administrator Mr. Russell Train's scheduled press conference on Monday, December 22.
Mr. Train is expected to state that PCB's are a real problem and must be phased out. The phast out must, however, be done responsibly and it will not be easy to do. EPA will not use Section 504 (imminent hazard) of the Water Pollution Control Act on the use of PCB's in capacitors. Warren's
source did not mention transformers, we, therefore, do not. know if trans
formers are deliverately eliminated or if the use of the word "capacitor" is intended to apply to both dielectric applications.
In early 1976, EPA will invite the manufacturer of PCB's and the capacitor
manufacturers to a meeting to discuss the phase out program. Later the
same invitation will be extended to utility companies and users of capacitors
to discuss the same subject.
'
A task force composed of representatives from government and industry is expected to be formed to atso consider PCB phase out.
EPA will issue effluent standards for PCB's and other chemicals in early 1976. It is anticipated that these regulations will represent a strict restriction on the amount of PCB's permitted in plant effluent discharges.
Mr. Train is also expected to make some remarks regarding the matter of proper disposal practices and will probably refer to the return of PCB materials to the manufacturers.

Warren hopes to get a draft of Mr. Train's statement on Thursday, December 13.

In response to your letter of December 1, I am not aware of any company recognized by EPA for handling equipment containing PCBs. I have personally discussed this matter with EPA representatives on several occasions.
To my knowledge the only practical method of disposal of solid waste containing PCBs is through burial in sanitary landfills. I know of no facility that can handle large quan tities of this type of material and destroy by high temperature Incineration.
Regarding your question relating to the procedure for handling spills, Curtis Lopes, Cornell Dubilier, has sent Monsanto a draft of a proposal for our comments. David Wood is reviewing

Tom Hughes, MRC, indicated that a full day would be required with the morning devoted to discussion and the afternoon to a plant visit. He also indicated he would like to take samples of air and water Affluent. He is also aware that both benzene and butane are used as raw materials and is very interested In the effect of raw material on effluent discharges.
Mr. Hughes assured me that confidentiality can be maintained and that secrecy agreements could be signed. Uiis request is simitar to many others we have received from EPA contractors. To my knowledge we have attempted to be cooperative but at the same time very careful. I recommend we meet with Mr. Hughes and have a discussion after carefully reviewing the "ground rules" with him. Jim Savage had requested information from both the Anniston and WGK plants. I am enclosing the responses I received. Will you please arrange to have this material consolidated In a form which can be forwarded to EPA.
The original deadlines for response have not been met. I have written to EPA, Washington, requesting extensions. I have as yet received no reply. I predict that any exten sion granted will not extend beyond December 15. Since Business Group and Legal clearance must be obtained before the report is released, a prompt response is requested.
