Willmore - 1290 In September, 1975, Ashland Chemical submitted phthalic anhydride specifications for our acceptance. A1 Uelner's and John Roarty's comments were discussed with Ashland Chemical. Harry Pugh informed us that Ashland was reluctant to make any exceptions; but suggested that we notify them before hand if there is a need to ship material which does not meet their specification. We rejected Ashland's proposed specifications primarily because we do not test for % phthalic anhydride or phthalate ester color; therefore, we are in no position to comply with Ashland's suggestion. I discussed with A1 and John the current procedure being followed which I understand is as follows: A sample of the shipment is analyzed for Crystallization Point, Color of Melt and Heat Stability. If any of these does not meet Ashland specification, Ashland will be informed before shipment is made. Unless anyone can foresee any problems, I suggest we continue to follow this procedure. Regarding Ashland's request for "Certificates of Analysis", we do provide "Certificates of Quality". I understand from Art Uelner that we show % phthalic anhydride and phthalate ester color on the certificates although we do not run these tests for each shipment. % phthalic anhydride may be shown but should be foot noted to show that it is determined on a statistically sound basis, but not for every shipment. Phthalate ester color should not be certified unless actually performed. I recommend each of you review your practices regarding the preparation of "Certificates of Quality" /ps 'C- W. B. Referring to the action plan issued September 18th (copy attached), all items have been completed except for Nos. 5 and 7. . Manufacturing management has a copy of Dr, Roush's employee exposure guidelines. Plant management plans to review them with the Medical Department before implementing. . George Levinskas informs me that drafts of the Industrial Bio-Test reports are virtually completed. Publication is possible by April if we buy an issue of the publication. If we cannot purchase, publication will be delayed to June-July.. Because of the impact that Dr. James Allen's primate study has had our Medical Department believes it is highly desirable that Monsanto sponsor some work with monkeys. A protocol will be prepared and sent to laboratories to determine the cost of such a study. Results of the study would not be available for at least one year.. Mr. Train is expected to state that PCB's are a real problem and must be phased out. The phast out must, however, be done responsibly and it will not be easy to do. EPA will not use Section 504 (imminent hazard) of the Water Pollution Control Act on the use of PCB's in capacitors. Warren's source did not mention transformers, we, therefore, do not. know if trans formers are deliverately eliminated or if the use of the word "capacitor" is intended to apply to both dielectric applications. In early 1976, EPA will invite the manufacturer of PCB's and the capacitor manufacturers to a meeting to discuss the phase out program. Later the same invitation will be extended to utility companies and users of capacitors to discuss the same subject. ' A task force composed of representatives from government and industry is expected to be formed to atso consider PCB phase out. EPA will issue effluent standards for PCB's and other chemicals in early 1976. It is anticipated that these regulations will represent a strict restriction on the amount of PCB's permitted in plant effluent discharges. Mr. Train is also expected to make some remarks regarding the matter of proper disposal practices and will probably refer to the return of PCB materials to the manufacturers. .
