Sincerely, CRMC-SC-004602 J July 11, 1974 RECENT DEVELOPMENTS REVISED OSHA ASBESTOS STANDARD As you know, the Occupational Safety and Health Administration, U. S. Department of Labor, is planning to revise the present asbestos standard. It is our belief they decided to do this because the Industrial Union Department, AFL-CIO filed suit against the Secretary of Labor petitioning for reconsideration of seven sections of the standard. The basic claim of the suit -- that the standard was inadequate to properly protect the health of workers exposed to asbestos. In our first discussions with OSHA personnel concerning their future actions, we formed the opinion that they would prepare a major revision or complete rewrite of the present standard. 1 On April 15, 1974, the Circuit Court of Appeals rendered its decision on the IUD lawsuit. The decision was basically favorable to the Department of Labor, since it denied all but two issues. These two, which were remanded to the Secretary of Labor for further considera tion, are: (1) The uniform application of the 1976 effective date for the two fiber asbestos standard. (2) The three year retention period for records of exposure levels detected by monitoring the work place . The Appeals Court's decision presently is being studied by the Solicitor General's office who in turn will re commend to the Secretary of Labor the course of action he should follow. This recommendation has not as yet been received by the Secretary. However, in discussing the Court's decision with people in the Division of Health Standards who are responsible for preparation of the revised asbestos standard, we have concluded that it has changed their thinking. The apparent preference now is to amend the present standard, including rewording and addition of new section's; but not to do a major revision or complete rewrite. We believe that prior to the court decision OSHA had been thinking of a new standard written around work practices. This has now changed. While OSHA officials still want industry to submit suggested work practices for inclusion in the amended standard, the scope and effective thrust of the work practices section will be lessened. Also, Af JM " 83 CRMC-SC-004603 Page 2 OSHA is now putting more emphasis on industry comment concerning the problems of the present standard and suggestions for rewording and amendment. The asbestos industry input is being provided by the Standards & Technical Committee of the Asbestos Information Association/North America, consisting of 13 members under chairmanship of E. M. Fenner of Johns-Manville. They expect to complete their input on work practices and other areas by July 15 and, at the present time, are not able to estimate when OSHA will issue a new proposed standard for asbestos. In order to provide you with greater detail on the subject, we are attaching comments from the April 22 and April 25 issues of the Occupational Safety and Health Reporter. Concerning the two items remanded by the court to the Secretary of Labor, it is our opinion: (1) that the effective date of the 2 fiber standard will not change, and that staggered implementation dates will not be utilized. (2) that the retention period for monitoring records will increase - possibly to twenty years. E.M. It lends itself to any wet system with high intensity mixers. Polyethylene bags are being used in the floor tile and asphalt paving industries where they can be added to the mixer without being opened. The bags melt at 250 F and become a part of the mix. To assist in accomplishing this, J-M has developed systems such as palletized units, shrink wrapping with polyethylene, and the assigned rail car. The text of Fire- Safe Curtains this surprise revision is contained in The Federal Register, . Vol. 40, No. 197 -- Thursday, October 9, 1975. Basically '' the proposed standard would institute the following changes i I in the current regulations: 1) Lower the permissible exposure level to 0.5 fibers/^cc Highway Safety f. from the current level of 5 fibers/cc and the July 1, 1976 level of 2 fibers/cc. 2) Lower the permissible ceiling concentration to 5 fibers/cc from the current 10 fibers/cc. i 3) Extend the record retention period for medical and monitoring records to 40 years or the duration High Speed Brakes of employment plus 20 years whichever is longer. As an alternative we plan to provide the information we develop to the Asbestos Information Association/North America -- (A.I.A./N.A.). The A.I.A./N.A. was formed in December 1970 to coordinate the efforts of the asbestos industry in disseminating authoritative information concerning asbestos and the asbestos industry with emphasis on the safety, health, and environmental issues. Currently, it consists of twenty-two asbestos companies in the U.S. and Canada. The objectives of the Association are: 1) To provide industry-wide information on asbestos and health, and on industry efforts to eliminate existing hazards. 2) To cooperate with governmental agencies in developing and imple menting industry-wide standards for worker protection and for the control of asbestos dust emissions into the community air and water. 3) To exchange information On methods and technique^-of'fdsb'estos dust control. ` . - V, ' " /. . Baumgardner, being of full age and first duly sworn do hereby state: 1. Iam not a party to this action. I have personal knowledge ofthe facts set forth in this affidavit, and if called as a witness, I could and would competently testify as to the truth of the matters set forth herein. 2. I am the Research Coordinator for the Claims Resolution Management Corporation ("CRMC"), a wholly owned subsidiary ofthe Manville Personal Injury Settlement Trust ("Trust"). The CRMC was created in December 1998 and is staffed by former Trust employees. On January 1, 1999, CRMC began providing claims resolution facility services to the Trust. 3. In this position, I manage the Asbestos Claims Research Facility ("Facility"), a document and records repository located at 3390 Peoria Street, Suite 304, Aurora, Colorado. The Facility contains the business records including but not limited to correspondence, memoranda, reports, records and data compilations ("record") of Manville Corporation or related entities ("Manville"), generally, as well as Manville records relevant to litigation of asbestos liability. The Trust has managed and operated the Facility from November 28, 1988, the date on which the Manville bankruptcy plan was consummated. 4. My experience and familiarity with the documents at the Facility began in 1983 while working for Manville. In my work as a paralegal for Manville, I assisted in locating, indexing and packing many of the records which became the foundation documents for the Facility. I continued to work for Manville until September 1987. From March 1988 to September 1988,1 was hired to supervise and assist in the indexing of the first 20,000 boxes which were turned over to the Trust in November 1988. From September 1988 to January 1989, I assisted in the privilege review of documents to be given to the Trust. From November 1988 to April 1994,1 worked for Freeborn & Peters and was put in charge of the Facility, managing all productions and "new" acquisitions. In September 1995,1 was hired by the Trust to manage the Facility. In December 1998,1 was hired by the CRMC to manage the Facility for the Trust. Accordingly, I am personally familiar with many of the records stored at the Facility, as well as how the records have been gathered. 5. To the best ofmy knowledge, information and belief, I certify that these records were made at or near the time by, or from information transmitted by, a person with knowledge, were kept in the course ofthe regularly conducted business activity ofManville, and it was the regular practice and the business activity of Manville to make the records. 6. Documents from this Facility were copied for the firm of Simmons, Cooper. The copies have come from subject file 106 at the Facility and are bates labeled CRMC-SC-0004601 through CRMC-SC-004646 and these documents are true and correct copies of documents found at the Facility.
